On and after March 1, 2025, a retailer, or microbusiness with listed retail activities, shall display this brochure, including printed copies, at the point of sale or final delivery in person and online at time of online purchases, and offer each new consumer a copy of the brochure.
What does this mean for your business? You need to go to the California DCC website and download the brochure. There you will find a color version as well as a black and white version. Next, you need to display it by the POS in your shop. If you deliver your products, your customers need to get one. It also requires you give one to any “new” customers which we think may be kind of tricky. Anyway, it defines a new customer this way: “Individuals are considered a new consumer if it’s their first time purchasing at your store.”
Nonetheless, according to the California DCC SB 540 FAQ: All licensed retailers, including storefront and delivery, are required to provide the brochure to new consumers. This includes licensed microbusinesses with listed retail activities. Check out the full FAQ list and print out your copy of the brochure while you’re there.
When printing the brochure:
- It is the responsibility of the licensee to print and provide the brochures to first time consumers.
- The brochure must be offered to each new consumer. The brochure must also be prominently displayed:

- Online at the time of online purchase
- At the point of sale or final delivery in person, including printed copies

- The brochure must be printed in a type size not smaller than 12 points and on one side of a standard 8 ½” x 11” piece of paper. Licensees may print ad provide the black and white or color version of the brochure.
- The brochure cannot be altered in any way. The blank side of the brochure must remain blank. No images, marketing, advertising, or other information can be added to either side of the brochure.
